Uzbekistan is a party to key international intellectual property agreements, including the TRIPS Agreement, the Paris Convention, the Nice Agreement on classification of goods and services, and the WIPO Convention. It is also a member of the Madrid Protocol, which allows international trademark protection through a single filing while offering a strong framework for safeguarding commercial marks nationally. Trademark protection in Uzbekistan is governed by the national Law on Trademarks and administered by the Agency for Intellectual Property.

1. Application Routes

2. Required Documents for Trademark Registration

-Applicant’s full name and address

-Trademark specimen (logo, word mark, or combination)

-List of designated goods or services according to the Nice Classification

-Signed Power of Attorney (local representation required for non residents)

-Priority document with translation if a priority claim is made

3. Trademark Registration Process
• Application Submission

Applications are filed with the Agency for Intellectual Property. Foreign applicants must be represented by a certified Uzbek trademark attorney.

• Examination

The application undergoes a formal review for completeness, followed by substantive examination where the Agency evaluates whether the mark is distinctive, non deceptive, and does not conflict with existing rights. Examination may take several months.

• Publication and Observations

Once the application passes examination, it is processed toward registration. Third parties may submit observations during examination if potential conflicts with existing rights are identified.

• Approval and Registration

If the mark meets all legal requirements, a registration decision is issued, and exclusive rights are granted. The certificate confirms the trademark owner’s legal rights in Uzbekistan.

4. Validity Period and Renewal

A registered trademark in Uzbekistan is valid for ten years from the filing date. Renewal can be requested within the last year of validity and up to six months after expiry with payment of an additional fee, extending protection for another ten years.

5. Important Notes

-Uzbekistan uses the Nice Classification system for goods and services.

-Non resident applicants must act through a licensed local trademark attorney.

-Trademarks not continuously used on relevant goods or services may be subject to cancellation actions.

-Signs that mislead consumers, such as official state emblems or flags, cannot be registered.
