Trademark Registration in Azerbaijan

Azerbaijan protects trademarks under its national trademark legislation, with applications processed by the Intellectual Property Agency of the Republic of Azerbaijan. A registered trademark grants the owner exclusive rights to use the mark in connection with the goods or services listed in the registration. Azerbaijan is also a member of the Madrid Agreement and the Madrid Protocol, enabling international extensions of trademark protection through a single international application. The system is based on a first to file principle and provides legal certainty to rights holders.

2. Required Documents for Trademark Registration

-Applicant’s full name and address

-Trademark specimen (logo, word mark, or combination)

-Signed Power of Attorney (required for filings through a representative)

-Priority document with translation if priority is claimed

Foreign applicants must work through a licensed local trademark attorney for filing and prosecution. Accurate preparation of all documents helps prevent delays and objections during examination.

3. Trademark Registration Process
• Application Submission

The trademark application is filed with the Intellectual Property Agency of Azerbaijan and must include all required documents and proof of fee payment. Non resident applicants typically must appoint a local representative.

• Examination

The Agency conducts formal and substantive examination to ensure that the mark complies with legal requirements, is distinctive, and does not conflict with earlier rights. Examination timelines can vary, and the process often takes several months to complete.

• Publication and Observations

Azerbaijan does not have a formal opposition period after publication. However, third parties may file informal observations during the examination phase if they believe the mark conflicts with their rights.

• Approval and Registration

After examination is complete and any issues are resolved, the Agency issues a registration decision. The applicant must pay the registration fee within the prescribed period, after which the mark is entered into the official trademark register and a certificate of registration is issued.

4. Validity Period and Renewal

A trademark registration in Azerbaijan is valid for 10 years from the filing date. Protection can be renewed indefinitely for additional 10 year periods by filing a renewal application during the final year before expiration or within a six month grace period after the expiry with payment of an additional fee. Evidence of use is not required for renewal.

5. Important Notes

-Azerbaijan follows the International (Nice) Classification system, and multi class applications are allowed with fees applicable per class.

-Non resident applicants must be represented by a licensed Azerbaijani trademark attorney for filing, prosecution, renewal, and other formal actions.

-A registered trademark may be vulnerable to cancellation on grounds such as non use if it has not been used in Azerbaijan for five continuous years after publication.

-Use of the mark during the registration process is permitted and does not affect rights once the mark is registered.
