3. Trademark Registration Process
• Application Submission
Trademark applications are submitted to Sakpatenti, typically in Georgian or with an accompanying translation, and must include all required documents and proof of fee payment. Foreign applicants must be represented by a certified Georgian patent attorney.
• Examination
The office conducts initial formal examination to check compliance with filing requirements, followed by substantive review where the mark’s distinctiveness and potential conflicts with existing rights are evaluated. This stage can take several months.
• Publication and Observations
Once the examination is successful, the application data is published officially. During this period, interested parties may submit observations if they believe the mark conflicts with their rights.
• Approval and Registration
If the application satisfies all legal criteria and no unresolved conflicts arise, Sakpatenti issues a registration decision. The mark is then entered into the trademark register and a certificate is issued confirming legal protection.
4. Validity Period and Renewal
A registered trademark in Georgia remains valid for 10 years from the date of filing. Protection can be renewed indefinitely for successive 10 year periods upon timely payment of renewal fees. Renewal applications are usually filed in the final year of the current term, and a grace period is often available with additional fees if the deadline is missed.
5. Important Notes
-Georgia follows the Nice Classification system, and multi class filings are permitted with additional fees per class.
-Trademark rights in Georgia become enforceable only upon registration; mere use of a mark abroad does not create protection locally.
-To avoid objections or refusals, marks must be distinctive and not conflict with existing registrations or well known marks.
