3. Trademark Registration Process
• Application Submission

The full trademark application must be submitted to Kyrgyzpatent, typically in Kyrgyz or Russian, with all required attachments and proof of fee payment. Foreign applicants are generally required to be represented by a registered local trademark practitioner.

• Examination

Kyrgyzpatent conducts a formal and substantive review of the application, assessing compliance with legal formalities, distinctiveness of the mark, and potential conflicts with earlier rights. This phase can take several months to complete.

• Publication and Observations

Once initial requirements are satisfied, the application proceeds toward registration. During this stage, interested parties may submit observations if they believe the mark conflicts with existing rights.

• Approval and Registration

If the application successfully meets all legal criteria, Kyrgyzpatent issues a registration decision and records the mark in the official register. A certificate is then issued, confirming the trademark owner’s exclusive rights under Kyrgyz law.

4. Validity Period and Renewal

A trademark registered in Kyrgyzstan remains valid for 10 years from the filing date. Trademark owners can request renewal during the last year of the current term, and protection can be extended indefinitely for successive 10 year periods upon payment of renewal fees. A grace period following expiration may be available with payment of additional late fees.

5. Important Notes

-Kyrgyzstan follows the Nice Classification system, and multi class applications are permitted with fees applicable for each class.

-Trademarks must be inherently distinctive and must not consist of generic, purely descriptive, or misleading signs, including official state symbols or flags.

-Trademark rights in Kyrgyzstan are granted only through registration; use of the mark abroad does not establish local protection without a registered application.

-A registered trademark that has not been used for a continuous period (typically three years) may be subject to cancellation upon request by an interested third party.
