Trademark Registration in Turkmenistan

Turkmenistan offers formal trademark protection under its national Law on Trademarks, administered by Turkmenpatent (the State Service for Intellectual Property of the Ministry of Finance and Economy). A registered trademark gives the owner exclusive rights to use and enforce the mark in connection with the listed goods and services, and to prevent others from using identical or confusingly similar marks. Turkmenistan applies a first to file principle, meaning that legal rights are normally secured by the first filed application rather than by use alone. The country is also a member of international treaties, including the Paris Convention and the Madrid Protocol, allowing extension of international registrations to Turkmenistan.

2. Required Documents for Trademark Registration

-Applicant’s full name and address

-Clear representation of the trademark (verbal, pictorial or three dimensional mark or combination)

-If priority is claimed, a certified copy of the priority document may be submitted within a specified period after filing

3. Trademark Registration Process
• Application Submission

The trademark application must be submitted to Turkmenpatent in Turkmen or Russian. Documents may be filed in other languages, but translations may need to be provided later. Foreign applicants are generally required to be represented by a licensed Turkmen trademark attorney.

• Examination

Turkmenpatent conducts both formal and substantive examination, checking that the application meets legal formalities, that the mark is distinctive, and that it does not conflict with earlier registered marks or prior rights. This process can take several months.

• Publication and Observations

After formal examination, applications are processed and details may be published in the official bulletin. Interested parties may file objections during examination if a conflict with existing rights is identified.

• Approval and Registration

If the mark satisfies all legal criteria and any objections are resolved, Turkmenpatent issues a registration decision and enters the mark into the official register. The applicant must pay the official registration fee within the prescribed period, after which a certificate confirming the trademark’s registration is issued.

4. Validity Period and Renewal

A trademark registered in Turkmenistan is valid for 10 years from the filing date. Protection can be renewed indefinitely for successive 10 year periods by filing a renewal request during the last year of the current term or within a six month grace period after expiry, subject to payment of an additional fee. Renewal extends legal protection for another 10 year term.

5. Important Notes

-Turkmenistan follows the International (Nice) Classification system, and multi class applications are permitted with additional fees per class.

-Foreign applicants must be represented by a registered Turkmen patent or trademark attorney to file and prosecute applications.

-Marks that are generic, descriptive, misleading, or identical/confusingly similar to existing registrations are not allowable and may be refused.

-Failure to use a registered mark continuously for three years after registration may expose it to cancellation on request by an interested party.
