2. Trademark Registration Process
• Application Submission

The trademark application must be submitted to the Turkish Trademark Office, either directly or through a local agent authorized to act on behalf of the applicant.

• Formal Examination

The office reviews the application for completeness and adherence to formal requirements. If deficiencies are found, the applicant is granted a two-month period to correct them. Failure to respond within this timeframe will lead to cancellation of the application.

• Substantive Examination

During substantive examination, the examiner evaluates whether the trademark meets legal requirements. If a refusal is issued, the applicant may submit a written appeal for re-examination and re-evaluation within two months from the receipt of the decision. If the refusal is confirmed, the applicant can file a lawsuit at the Intellectual Property Court within two months to annul the decision.

• Publication

After successfully passing examination, the trademark is published in the official gazette. Third parties may submit oppositions within two months of the publication date. The Turkish Trademark Office operates a dedicated opposition department to handle these cases efficiently.

• Registration

Following successful examination and resolution of any opposition, the trademark is officially registered under Turkish law, granting legal protection to the owner.

3. Important Considerations

-Turkish trademarks follow the Nice Classification system and allow multi-class filings in a single application

-Non-resident applicants must appoint a local agent to manage their trademark applications in Türkiye

-If a registered trademark has not been used for five consecutive years, except in cases of force majeure, any third party may request its cancellation

4. Validity and Renewal

A Turkish trademark is valid for 10 years from the filing date. Owners can renew the registration to extend protection for additional 10-year periods, ensuring long-term legal security for their brand
