3. Trademark Registration Process
• Application Submission

Trademark applications must be filed with NCPI. The application should include all required attachments and evidence of fee payment. Foreign applicants are typically required to be represented by a registered local trademark attorney.

• Examination

NCPI conducts a formal and substantive examination. The formal examination checks that all documentation is complete and compliant with statutory requirements. Substantive examination assesses whether the mark is distinctive and does not conflict with existing trademarks.

• Publication and Observations

Once the application passes examination stages, it moves toward registration. There is no formal opposition period; however, during the examination phase, interested parties may submit observations if they believe the applied mark conflicts with earlier rights.

• Approval and Registration

If the trademark meets all criteria and any objections are resolved, NCPI issues a registration decision. The mark is then entered into the official register and a registration certificate is issued, confirming exclusive rights under Tajik law.

4. Validity Period and Renewal

A trademark registered in Tajikistan is valid for 10 years from the filing date. Protection can be renewed indefinitely for further 10‑year periods. Renewal applications should generally be filed in the final year of the current term, and a grace period may be available with payment of additional fees if renewal is missed.

5. Important Notes

-Tajikistan follows the International (Nice) Classification system and allows multi‑class filings with additional fees per class.

-Trademarks must be inherently distinctive and should not consist of generic or deceptive elements that may mislead consumers or conflict with existing protected rights.

-Foreign applicants are required to be represented by a registered trademark attorney for filing and prosecution in Tajikistan.

-A registered trademark that is not used in Tajikistan for a continuous period (typically three years) may be subject to cancellation on request by an interested party
