2. Required Documents for Trademark Registration

-Applicant’s full name and address

3. Trademark Registration Process
• Application Submission

Submit the trademark application either online or offline at the Kazakh Patent Office.

• Examination

The office reviews the application to ensure compliance with legal requirements and checks for potential conflicts with existing trademarks.

• Publication and Observations

Once the application passes examination, it is published in the official gazette. During the publication period, any third party may file an opposition if they believe the trademark conflicts with their rights.

• Approval and Registration

If no opposition is filed, or after any opposition is resolved, the trademark is approved, and a registration certificate is issued, granting legal protection under Kazakhstan law.

4. Validity Period and Renewal

The trademark is valid for 10 years from the registration date. Renewal applications must be submitted within 6 months before the expiration date, with each renewal extending protection for an additional 10 years. A grace period of 6 months after the expiration date is allowed for late renewals, subject to payment of additional fees.

5. Important Notes

-Trademarks containing geographical indications for products such as mineral water, wine, or spirits, which falsely suggest origin, cannot be registered

-Use of translated terms or names accompanied by words like “type,” “style,” or other similar descriptors is not permissible

-Proper legal and professional guidance is recommended to avoid objections or rejection during the registration process

The national authority responsible for trademarks, patents, industrial designs, and other IP rights in Kazakhstan; under the Ministry of Justice.
